Will
A will is a written legal document in which you give instruction about how your assets will be distributed and how your debts will be repaid following your death. In a probate hearing, a will also tell the court what to do with your property, debts and other affairs.
Living Trust
A living trust is drafted while you are still alive and through it, your assets are kept in a trust for your benefit which are transferred to designated beneficiaries at your death. You will choose
a representative or “successor trustee” to decide who will distribute your assets. Unlike a will, a living trust
avoids probate and is not made public upon your death.
What Is a Pour-Over Will?
This is a type of will that is used with a living trust that “pours” all of the assets belonging to the testator into a trust that he or she created before death. It requires any assets that were not transferred into the trust during the individual’s lifetime to be placed into the trust at death.

decisions for themselves.
